Densely populated neighborhoods and a variety of property types in Seattle leave the door open for a variety of property disputes. These can cause serious tension between property owners, and it could lead to legal actions. 

Anyone who owns property in the Seattle area should be aware of some of the more common property disputes so they can take proactive steps to minimize the chance of being affected by them. This information may also help them to determine if there’s anything they need to address with another property owner. 

Property line disputes

Disagreements over property lines are prevalent in Seattle, especially in older neighborhoods where historical records may be unclear. Conflicts often arise when fences, sheds, or landscaping features are believed to cross into neighboring properties. These issues often require a survey of the properties in question so that the proper boundary line is clearly established. From there, the property owners would have to correct any issues, such as misplacements of fencing or buildings. 

Failure to disclose required information

A person who’s selling a home is required to disclose certain information to potential buyers. When this doesn’t occur, a buyer could take legal action against the seller if they’re facing problems because of it. These cases are often complex because the problem with the home must be something that wasn’t obvious or that wouldn’t be discovered during a home inspection. The buyer will also have to prove that the seller knew about the information before the sale. 

Problems with easements

Some properties have easements attached to them. An easement allows someone other than the owner a specific use of part of the property. There are sometimes disputes about easements because one or both parties doesn’t understand the exact terms of the easement. It may also occur if a change to a current easement needs to be made.
